Somalia’s accession to the East African Community (EAC) in March 2024 marks a significant milestone in its regional integration efforts. However, legal and institutional differences pose substantial challenges to the country’s full participation in the bloc. This policy brief examines Somalia’s legal framework and its compatibility with EAC regulations, identifying key gaps in commercial law, trade agreements, dispute resolution mechanisms, and institutional capacity.

One major challenge is harmonizing Somalia’s legal system with those of other EAC member states, particularly in trade and investment laws. Additionally, Somalia’s institutional capacity remains weak, limiting its ability to effectively engage in decision-making processes within the EAC framework. The brief recommends a phased approach to integration, allowing Somalia to gradually align its legal frameworks, strengthen governance structures, and build capacity to meet regional standards.

To facilitate this process, the brief suggests establishing a legal harmonization task force, providing technical assistance for institutional reforms, and leveraging support from regional and international development partners. Capacity-building programs should be prioritized to enhance the effectiveness of Somalia’s government institutions in implementing EAC policies.

Somalia’s successful integration into the EAC will unlock economic and geopolitical benefits, fostering regional stability and increased trade opportunities. However, this requires strong policy coordination, stakeholder engagement, and long-term legal alignment efforts. By adopting a structured and inclusive approach, Somalia can fully integrate into the EAC and contribute to the bloc’s collective growth and stability.
